1. The service
The gallerists.com service is operated by the administrator of the gallerists.com service ("we", "us"). Gallerists is software for art galleries, dealers and advisors to manage artwork inventory, artist records, offer PDFs, online viewing rooms, collector contacts, consignments, invoices and listings in a public guide. The features and limits of each plan are described on the art gallery software pricing page. Contact: [email protected].
The service is intended for businesses and professionals. By creating an account you confirm that you use the service for business purposes and that you are authorized to accept these terms for the gallery or business you represent.
2. Accounts
- You must give a valid email address and confirm it with the code we send
- You are responsible for keeping your password confidential and for all activity in your account, including activity of the team members you invite
- Seats are for named individuals and may not be shared between several people
- Tell us at [email protected] if you suspect unauthorized access
3. Subscriptions, renewals and payment
- Every paid plan is a subscription billed monthly or yearly in advance, in US dollars
- Subscriptions renew automatically at the end of each period at the then current price until you cancel
- Payment is taken by card through our payment processor. Enterprise accounts may move to invoice billing by bank transfer after the first card payment
- Prices exclude applicable taxes, which are added where required
- An upgrade to a higher plan or to yearly billing charges the difference immediately, and the new limits apply once it is paid. A downgrade applies from the next renewal
- If a renewal payment fails, we retry it. The payment remains due, and we may limit the account until it is paid
- Usage allowances are counted as consumption within the billing period. Deleting an item does not restore the allowance. Unused allowances do not carry over
4. Cancellation and final payments
You can cancel at any time in your account. Cancelling stops future renewals, and you keep access until the end of the period you have paid for. Payments are final and are not refunded, except in the limited cases set out in the refund policy. Starting a chargeback instead of following the refund policy is a breach of these terms and leads to closure of the account.
5. The demo
The homepage demo lets a visitor create one watermarked artwork record per day without an account. Demo output is a preview, may be partly hidden and may not be used commercially without an account.
6. Your data and content
You own the content you add to Gallerists, including images, artwork records, artist records, collector contacts and documents. You grant us a limited license to host, process, display and transmit that content only as needed to provide the service to you, including publishing what you choose to publish in the public guide. You can export your inventory, artists and contacts as CSV at any time.
You are responsible for having the rights and permissions needed for the content you upload, including images of artworks and the personal information of collectors and artists you store, and for handling that information lawfully.
7. Listings in the public guide
Information you publish to the guide must be accurate and current. We may edit the layout, refuse or remove listings that are misleading, unlawful or outside the purpose of the guide. Collectors' inquiries sent through your profile are delivered to your account, and the sale that follows is between you and the collector. We are not a party to any sale of artwork.
8. AI catalog descriptions
AI catalog descriptions are drafts generated by an AI model from the image and details you provide. They can contain errors, including wrong facts about medium, dimensions, dates or artists. You must review and edit every description before you use it in an offer, a viewing room, an invoice or a listing, and you are responsible for the text you publish or send. Plan limits apply to the number of descriptions per month.
9. Acceptable use
You agree not to:
- Upload content you have no right to use, or content that is unlawful, infringing, deceptive or harmful
- Offer works you are not authorized to sell, or misrepresent the authenticity, provenance, condition or ownership of a work
- Send unsolicited bulk messages through the service
- Attempt to access other accounts, probe or break the security of the service, or interfere with its operation
- Scrape the service or the guide, resell access, or use the service to build a competing product
- Use the service in breach of sanctions, export or anti money laundering laws
We may suspend or close an account that breaches this section, and where the breach is serious we may do so without notice.
10. Our service and intellectual property
The software, design, text of the website and the Gallerists name belong to us or our licensors. These terms give you a right to use the service during your subscription and nothing more.
11. Availability and changes
We work to keep the service available and secure, but we do not guarantee uninterrupted operation, except under the uptime commitment included in the Enterprise plan. We may change or improve features. If a change materially reduces the features of your paid plan, we tell you in advance by email.
12. Disclaimers and limitation of liability
The service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim implied warranties, including merchantability, fitness for a particular purpose and non infringement. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost sales or lost data, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
13. Indemnity
You agree to defend and indemnify us against claims arising from your content, your listings, your sales of artwork or your breach of these terms.
14. Termination
You can close your account at any time. We may suspend or terminate access for breach of these terms or non payment. After closure we delete your data as described in the privacy policy, so export what you need before closing.
15. General
These terms are the entire agreement between you and us about the service. If any part is found unenforceable, the rest remains in force. We may update these terms, and the date at the top shows the latest version. Material changes are sent to account holders by email and apply from the next billing period. Questions about these terms: [email protected].
